Reporting to the Manager, Healthy Environments, Tobacco, Vapour & Cannabis Enforcement, identifies and investigates issues of non-compliance with all smoking/vaping legislation in retail, public places, workplaces and other prescribed place settings, ensures compliance with Provincial Acts and associated Regulations and municipal by-laws [i.e. Smoke Free Ontario Act, Municipal Code Chapter 709 - Smoking, Municipal Code Chapter 545 - Licensing (prohibition of water pipe use in licensed premises), and takes action to develop and implement education, inspection and enforcement programs.
- Develops and implements inspection and enforcement plans
- Conducts inspections, investigations and enforcement in accordance with Provincial Acts and Regulations and municipal by-laws [i.e. Smoke Free Ontario Act, Municipal Code Chapter 709 - Smoking, Municipal Code Chapter 545 - Licensing (prohibition of water pipe use in licensed premises)
- Conducts on-site assessments, inspections and investigations in licensed premises, public places and workplaces (i.e. retail establishments, hospitals, nursing homes, group homes, recreational facilities, restaurant patios, public sporting surfaces, public playgrounds)
- Participates in and contributes to program policy development
- Develops, implements and maintains operational procedures, information systems, administrative documentation and record control for enforcement programs
- Develops and maintains working knowledge of tobacco/vapour products, manufacturers, display and storage provisions, product content, weights and measures, safe handling and disposal
- Develops and maintains working knowledge of other enforcement partners jurisdiction and develop and maintain working relationships with these partners (i.e. Health Canada, Ministry of Finance, RCMP)
- Monitors tobacconists and specialty vape shops and verifies exemption status
- Conducts seizures of illegal tobacco products. Collects, documents, stores and disposes of evidence in accordance with related policy and legislation
- Issues automatic prohibitions upon receipt of the notice from the Ministry of Health to tobacco vendors convicted of selling tobacco to youth and monitors them for compliance
- Inspects and investigates smoking shelters and Controlled Areas, ensures compliance with legislation. Reviews plans, ventilation and maintenance log.
- Advises business proprietors regarding non-compliance and provides technical advice and best practice guidance
- Participates in policy development with vendors, business proprietors and employers to gain long term compliance
- Educates clients of the legislative requirements for their premises and works with them to attain or maintain the required standards. Identifies violations, interprets the legislative requirements and develops a course of action with the client. In consultation with the client, establishes priorities to achieve compliance, monitors progress and provides additional assistance
- Develops and delivers a wide range of educational materials and training sessions to multiple stakeholders regarding their obligations under the SFOA and municipal by-laws and/or other public health legislation as required. Tailors detailed and technical information to meet their unique needs (i.e. hospital boards, administrators of long-term care homes, property management companies, retail chain staff, City divisional staff)
- Delivers public education campaigns to promote legislative changes and increase compliance. Prepares and delivers presentations to community groups, schools and agencies
- Investigates complaints, conducts surveillance and takes action. Responds to emerging issues
- Executes joint inspections and shares intelligence with Toronto Police Services, Ministry of Finance, Alcohol and Gaming Commission of Ontario or other partner enforcement agencies as required
- Conducts interviews of complainants, offenders, witnesses and others having relevant information
- Completes and processes legal documentation in accordance with recognized standards. Prepares documentation to initiate corporate searches. Prepares and serves warning letters, Provincial Offences notices and summonses as Provincial Offences Officers. Coordinates legal activities with the Legal Division and provincial courts, and coordinates the preparation of legal briefs
- Attends court and gives evidence as an expert witness. Executes search warrants. Initiates and enforces prohibition orders for tobacco retailers that have been prohibited from selling tobacco
- Designs, implements and evaluates tobacco use prevention programs, interventions and procedures to reduce tobacco use. Assists in incorporating the division’s strategic priorities into the annual work plans
- Recruits, selects, trains and evaluates the performance of tobacco and vapour product test shoppers. Prepares contracts and schedules work and court appearance. Provides supervision of test shoppers
- Implements, coordinates and assists local programs, including special events, provides pre-event guidance and support to operators to ensure compliance (ie: Caribana, Pride and other festivals, etc.)
- Participates on committees, work groups, citywide projects and enforcement initiatives with other department staff, City divisions and external agencies.
- Provides direction and consultation to new staff and students. Assists in the orientation of groups or individuals such as medical students and other health professionals
- Responds to telephone, written and electronic inquiries. Provides information to the community
- Reports detailed and accurate inspection findings, to the Ministry of Health, Tobacco Inspection System (TIS), within 24 hour directive. Prepares and submits Complaint Request for Service Investigation Reports (CRSIR)
- Prepares correspondence and reports
Your application must describe your qualifications as they relate to:
- Experience in the application and enforcement of the Smoke-Free Ontario Act and/or other public health legislation, or provincial legislation of comparable scope and complexity.
- Experience in communicating and/or developing educational materials on legislative requirements. .
- Certificate or diploma in Municipal By-Law Enforcement or Law Enforcement, or the approved equivalent combination of education and experience.
- Experience with information systems/databases that support enforcement programming such as Microsoft Office Suite – i.e.: Word and Excel.
- Possession of a valid Class "G" Driver's License and access to a vehicle.
- Ability to organize field work; exercise initiative; exercise independent judgement and work with minimal supervision.
- Investigative work in an enforcement environment as a Provincial Offence Officer issuing Provincial offences notices, summonses and subpoenas and presenting evidence in court, is an asset.
