This position is with the Government of Alberta in Edmonton. The Metis Settlements Appeal Tribunal (MSAT) is an operationally independent, quasi-judicial agency whose overriding consideration is to preserve and enhance Métis culture and identity, and to strengthen Métis self-governance under the laws of Alberta. As a legislated alternative to court, MSAT strives to resolve disputes through adjudication, mediation and education in a manner that is fair, timely and cost-effective. MSAT is viewed as a credible, fair and effective dispute resolution body for resolving disputes on the Metis Settlements. The Tribunal Secretary is appointed in accordance with Section 210 of the Metis Settlements Act and reports to the Chair of the Metis Settlements Appeal Tribunal and the Executive Director of Metis Relations. The primary purpose of this role is to provide managerial and legal support to ensure the Tribunal fulfills its mandate of resolving disputes fairly, efficiently, and in a culturally appropriate manner that respects and enhances Metis culture and identity.

Key Responsibilities

  • Supports the MSAT Chair in administration of MSAT's quasi-judicial processes, including development of orientation and training initiatives, strategic plans, rules of procedure, code of conduct, annual and other reports, and communications with stakeholders (including outreach initiatives and development and adherence to mandate and roles document).
  • The Tribunal Secretary also works with the Chair (and external counsel when necessary) to manage appeals before the Alberta Court of Appeal.
  • Provides legal support and guidance to Board members concerning MSAT's dispute resolution processes and decisions.
  • Coordinates MSAT's dispute resolution processes, including assigning staff to appeals, providing guidance and direction to staff concerning investigations, conciliation activities, and timely issuance of reports and hearing packages.
  • The Tribunal Secretary also works with staff to develop and meet training and performance targets.
  • Works with Tribunal Office Manager and others to ensure all operational requirements and obligations are met.
  • Maintains and strengthens communications with key stakeholders to ensure planning and operational obligations are met, as well as ensuring emerging issues are resolved in a timely manner.

Qualifications

4 years university graduation in a field related to the position (Indigenous/Native Studies, Business Administration, Law, Indigenous Governance, Public Administration), supplemented by seven years related experience.

Equivalency: Related experience or education may be considered as an equivalency on a one for one basis.

  • Cultural Competence: Understanding of Metis culture, traditions, and community dynamics is essential. This includes knowledge of the historical context of Indigenous rights and governance, enabling effective communication and relationship-building with Indigenous communities.
  • Legal Knowledge: Administrative law, judicial standards of review, and alternative dispute resolution processes.
  • Conflict Resolution Expertise: Alternative dispute resolution techniques tailored to Indigenous contexts. This includes skills in mediation, negotiation, and consensus-building, which are crucial for addressing disputes in a culturally sensitive manner and fostering harmony within communities
