The Financial and Consumer Services Commission (Commission) is a leader in integrated financial and consumer services regulation. FCNB's mandate is to protect consumers and enhance public confidence in the financial and consumer marketplace through the provision of regulatory and educational services. With offices in both Fredericton and Saint John, it is responsible for the administration and enforcement of provincial legislation regulating mortgage brokers, payday lenders, real estate, securities, insurance, pensions, credit unions, trust and loan companies, cooperatives, unclaimed property, and a wide range of consumer legislation. The Commission is a self funded Crown corporation responsible for the administration and enforcement of financial consumer services legislation.

Senior Legal Counsel - Legal Services (Saint John)

As Senior Legal Counsel you will assist the Director of Legal Services in providing legal research and advice to the Commission on a broad range of substantive operational matters minimizing risk to the organization and meeting business objectives.

You will also assist on an as needed basis with the provision of advice on regulatory policy matters by advising on and recommending policy initiatives and drafting the required documentation to implement policy. Additionally, you may be called upon to provide governance support to the Corporate Secretary's office.

Your Focus

  • Legal Advice: Provide legal counsel on regulatory, corporate, operational functions, compliance, employment law, intellectual property, and other regulatory matters.
  • Contract Management: Draft, review, and negotiate various commercial agreements, including vendor contracts, service agreements, and NDAs.
  • Procurement: Advise on contracting and purchasing under the Procurement Act, including preparing competitive bidding documents.
  • Legislative Compliance: Monitor compliance with local, provincial, and federal laws, and develop necessary compliance regimes for the Commission.
  • Risk Management: Identify legal risks, advise on mitigation strategies, and assist in problem resolution by evaluating and escalating issues.
  • External Counsel Liaison: Support the Director of Legal Services in managing legal matters and working with external counsel on litigation when needed.
  • Training and Education: Conduct training sessions for employees on compliance, ethics, conflict of interest, and contract management.
  • Policy Development: Review, draft, and formulate internal policies and directives that align with the Commission's goals, including supporting government legislative processes.
  • Collaboration: Work with other divisions to provide legal support and promote compliance with applicable legislation.
  • Legal Research: Conduct legal and policy research, analyze developments affecting the Commission, and provide recommendations to senior management.
  • Governance Support: Offer legal and administrative support to the Corporate Secretary's office as needed.

What you bring

  • Law degree and eligibility for membership in the Law Society of New Brunswick.
  • 7+ years' experience in the private or public sector in a role having the same level of responsibility.
  • Independent decision making.
  • Ability to provide in-depth analysis of issues.
  • Proven management skills.
  • Superior research, analytical, writing, and communication skills.
  • Experience in policy development and research.
  • Excellent communication and organizational skills and demonstrated leadership skills are required.

Additional Strengths

  • Written and spoken competence in English and French are an asset.

The Financial and Consumer Services Commission offers a competitive salary and benefit package as well as excellent opportunities for personal growth and challenge. Salary Range: $101,276 to $139,255 (annual compensation)
